Terms of Service

These Terms of Service (“Terms”) govern your use of the Castava LLC website and services, and any purchase you make through our storefront or corporate account channels. By using the Services or placing an order, you agree to these Terms.
1. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to make a purchase. You are responsible for keeping your login credentials confidential and for all activity under your account. If you open a corporate account, you confirm that you are authorized to bind the organization you represent.
2. Products and pricing
We try to describe products, images, and prices accurately, but errors can occur. Product packaging and appearance may vary from images shown. Prices are in U.S. dollars and may change without notice. If a product is listed at an incorrect price, we may cancel the order and refund any amount charged.
3. Orders and acceptance
An order confirmation email confirms that we received your order. It does not mean we have accepted it. We may refuse or cancel any order, including for suspected fraud, pricing errors, or limited availability. Quantity limits may apply.
4. Payment
Payment is due when your order is confirmed, unless you have an approved corporate account with invoice terms. You authorize us and our payment processors to charge your selected payment method for the full order amount, including applicable taxes and shipping.
5. Corporate accounts, purchase orders, and invoice terms
- Purchase orders become binding once Castava confirms them in writing.
- Net-30 or other invoice terms are offered at our discretion after credit review, and we may change or revoke them.
- Invoices are due within the stated term. Past-due balances may lead to suspended ordering privileges and a late fee of 1.5% per month or the maximum allowed by law, whichever is less.
- Tax-exempt organizations must provide a valid exemption certificate before ordering.
- Pre-printed terms on a customer’s purchase order do not apply unless Castava agrees to them in writing.
6. Shipping, returns, and refunds
Shipping, risk of loss, returns, and refunds are governed by our Shipping & Returns Policy, which is part of these Terms.
7. Food products
Grocery and confectionery items list their ingredients and allergen information on their packaging. Always read the label before eating. Castava is not the manufacturer of third-party food products and cannot guarantee products are free of allergens.
8. Intellectual property
All site content, including text, graphics, logos, and layout, is owned by Castava LLC or its licensors and is protected by law. You may not copy, reproduce, or use it for commercial purposes without our written permission. Product brand names belong to their respective owners.
9. Acceptable use
You agree not to misuse the Services. This includes attempting unauthorized access, interfering with site operation, scraping content, placing fraudulent orders, or violating any law.
10. Disclaimers
The Services and products are provided “as is” and “as available.” To the fullest extent permitted by law, Castava disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Manufacturer warranties, where offered, are provided by the manufacturer.
11. Limitation of liability
To the fullest extent permitted by law, Castava will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
12. Indemnification
You agree to indemnify and hold harmless Castava LLC and its members, employees, and agents from claims arising out of your breach of these Terms or your misuse of the Services.
13. Governing law and venue
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Somerset County, New Jersey, and you consent to their jurisdiction.
14. Changes
We may update these Terms at any time. Continued use of the Services after changes are posted means you accept the revised Terms.
